Discrimination
Another important change under the Fair Work Act 2009, is with regards to discrimination laws.
Under WorkChoices the dismissal of an employee on the grounds of certain attributes was prohibited. The Fair Work Act expands that prohibition on discrimination to include any "adverse action" including a refusal to employ, taken on the basis of attributes which include: race, colour, gender, sexual preference, age, physical or mental disability, marital status, family or carer's responsibilities, pregnancy, religion, political opinion, national extraction or social origin.
These rights will add to those rights which employees already have under State and Federal based discrimination laws.
